9.  INTELLECTUAL AND INDUSTRIAL PROPERTY:

 All contents of the Website are intellectual and industrial property of BIOM or, where appropriate, of third parties involved in the creation of the contents and services ofered on the WEBSITE and who have accepted their publication on the WEBSITE for the corresponding purposes. The fact of being a User of the Website does not grant any intellectual or industrial property right over the works and contents of the Website, unless otherwise contractually established between BIOM and the User. The contents include, but are not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as their graphic design and source or binary codes, and any other material.

Likewise, trademarks, trade names or distinctive signs are the exclusive property of BIOM or, where appropriate, of third parties involved in the creation of the content ofered, unless otherwise specified. The User shall at all times respect all intellectual and industrial property rights over the Website and, if applicable, over the contents developed by third parties for BIOM. Consequently, the User is expressly forbidden to transfer the intellectual property rights over the Website. Likewise, the User is forbidden to use, reproduce, copy, transform, transmit or exploit in any way the contents published on the Website without prior written authorization from BIOM or its owner.

BIOM provides all the contents of the Website in good faith and will make reasonable eforts to ensure that they are current and updated. However, BIOM assumes no liability with respect to the information on the Website or its use or access by the User.

The User acknowledges and agrees that in case of breach of any of its obligations contained in this Legal Notice, it shall be liable for its actions.

BIOM is not responsible for damages of any kind caused to the User due to failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the service of the Web page during the provision of the same, or previously.

BIOM is not responsible for the information and other contents integrated in spaces or web pages of third parties accessible from the Web portal through links, hyperlinks or links, nor for the information and other contents integrated in spaces or web pages of third parties from which the portal is accessed through links, hyperlinks or links.

BIOM also assumes no liability whatsoever for damages, losses, claims or expenses caused by:

• (IV) Security or navigation errors caused by a malfunction of the browser or by the use of non-updated versions of the same.

To the extent that it does not contradict the applicable law or any provision of this Legal Notice, BIOM shall not be liable to the User or third parties for any damages that may arise from the use of or access to the Website.

11.  NOTICE OF INFRINGEMENT OF RIGHTS:

 If any person or entity detects that its contents have been published on the Web without their consent, generating an infringement of intellectual or industrial property rights or the right to honor, privacy, image or any other right, you may notify BIOM, through:

• E-mail, by  means  of  a  message  sent  to  the  following  e-mail  address: contact@bioinspiredmaterials.com , with the subject “Infringement of Rights”.

In both cases the request must be accompanied by the following information and documentation:

• Suficient and clear identification of the content or protected right that has been violated, so that BIOM can locate it within the Web.
• Data allowing the identification of the claimant (name and surname, company name, identification document number) and a copy of the DNI, NIF, passport or similar oficial document, if required.
• Suficient contact information for BIOM to contact the claimant (e-mail address and telephone number).
• A signed statement in which the claimant declares that the information submitted is truthful and that he/she is the legitimate owner (or is authorized to act on behalf of the owner) of the content or right infringed.

12.  CONDITIONS OF INTERNATIONAL USE:

 The operation of the Website governed by this Legal Notice is managed by BIOM, with registered ofice in Spain.

The access and use of the Web by the User from a third country will be under the responsibility of the User. The User is solely responsible for complying with the laws of the country from which he/she accesses the Web and its contents.

BIOM reserves the right to modify the Legal Notice at any time at its sole discretion. For the resolution of any conflict or dispute between the User and BIOM that may arise from the Legal Notice or from the access and use of the Website, they expressly agree to submit to the courts and tribunals of the city of Barcelona (Spain), waiving any other general or special jurisdiction that may correspond to them.
